Conflicts of Interest: FCA Regulated Firms
This module provides conflicts of interest training to staff at FCA Regulated MIFID Firms and, in particular, provides Learners with an overview of the FCA conflicts of interest requirements.
These requirements consist of provisions set out in chapter 10 of the FCA’s Senior Management Arrangements, Systems and Controls sourcebook (SYSC 10) and directly applicable provisions set out in Commission Delegated Regulation (EU) 2017/565 (referred to by the FCA as the MiFID Org Regulation).
The module also includes a summary of recent FCA enforcement activity in the sector.
In addition, FSLearn can provide summaries of internal policies and controls which will enhance your Firm's conflict of interest risk framework (e.g. policies such as conflicts of interest, outside business activities, gifts, and entertainment, personal account dealing, whistleblowing).
Learners will gain an understanding of how the conflict of interest requirements apply to their role by completing a 3 part module, completing knowledge checks after each part, and then a final assessment. The module covers the following:
a) Introduction: CoI: General Observations & Regulatory Framework
b) Identification and Management CoI
c) Further CoI Requirements: Policy, Disclosure & Recordkeeping
a) FCA CoI Enforcement Actions
b) Internal Controls 1: [Internal CoI Policy summary]
Part 3: Internal Controls 2
[Summary of polices may include for e.g.:

b) Personal Account Dealings Policy
c) Gifts and Entertainment]
The duration of this 3 part module is approximately 40 minutes. Each part is followed by a knowledge check for which we have allocated 4 minutes overall to complete. We have allocated up to 30 minutes for the two-part assessment that follows the completed module (Part A Assessment: General CoI requirements, Part B Assessment: Internal Controls at specific firm).
